General Terms and Conditions of Sale

1. Introduction
These General Terms and Conditions of Sale (hereinafter, the "Conditions") exclusively govern the purchase and sale of personalized precious metal bars, called "Gift Gold", carried out through the IGE GOLD website owned by IGE GOLD S.p.A., accessible at the following URLs: https://ige.gold.
These Conditions have been drawn up in accordance with Legislative Decree no. 206 of 6 September 2005, containing the "Consumer Code", as coordinated and updated, most recently, pursuant to Legislative Decree no. 76 of 16 July 2020, converted with amendments by Law no. 120 of 11 September 2020.
2. Parties to the contract and applicable rules
The IGE GOLD website is managed by IGE GOLD S.p.A., with registered office in Via Giacomo Konz 104, 52100 Arezzo (AR), Italy, VAT number 02488190519, registration in the Arezzo-Siena Register of Companies no. REA AR-220605, fully paid-up share capital of Euro 1,000,000. The Company is registered with the OAM - Organismo Agenti e Mediatori - as a Professional Gold Operator with code OP038.
IGE GOLD S.p.A. acts as the seller of the goods purchased through the aforementioned website.
By accessing and operating on the IGE GOLD website, the user fully accepts these Conditions and acknowledges the relevant privacy policy, available through a special hyperlink.
3. Scope and definitions
These Terms govern the use of the site as well as all sales of consumer goods offered therein. For the purposes of these Terms:
Access to the ordering features is subject to the creation of a personal account. The user is responsible for the safekeeping of his/her access credentials, as well as for any activity carried out through the use of the same.

The contract is considered concluded only after the user has received the order confirmation and payment of the price in full. Confirmation will be sent to the e-mail address provided during registration.
7. Price, taxes and ancillary charges
Prices are shown in Euros, including VAT and tax charges. Shipping and handling charges, if applicable, will be detailed separately prior to order completion.
8. Payment methods
Payment must be made using one of the methods provided by the site. In the absence of authorization, the order will be canceled. You can be charged in one or more stages, depending on the payment method you select.
9. Terms and methods of delivery
1. Shipping times
Unless otherwise expressly indicated, the products will be shipped approximately within 3 (three) - 5 (five) working days from the confirmation of payment. In any case, IGE GOLD S.p.A. undertakes to guarantee the delivery of the goods no later than a maximum of 30 (thirty) days from the date of receipt by the user of the communication confirming the shipment, except in the event of events attributable to force majeure.
2. Force majeure and unserved territories
In the event of events that can be qualified as force majeure – including, but not limited to, natural disasters, civil unrest, strikes, pandemics, measures taken by the authorities or unavailability of logistics services – IGE GOLD S.p.A. reserves the right to suspend, postpone or, in the most serious cases, cancel the delivery, in particular in the territories that, even if only temporarily, are not serviceable by the appointed carriers. The update on the operation of the delivery areas will be guaranteed based on the periodic communications received from the affiliated logistics courier.
3. Courier replacement
IGE GOLD S.p.A. reserves the right, at its sole discretion, to designate and/or replace the courier in charge of carrying out the delivery, in order to guarantee the timeliness and efficiency of the service.
4. Non-delivery attributable to the customer
In the event that:
• the user, without justified reason, refuses or delays the receipt of the goods;
• does not provide the necessary information for delivery;
• or indicates an incomplete or incorrect address that makes delivery impossible,
the product will be returned to IGE GOLD S.p.A. and the latter will be exempt from any obligation to deliver within the established terms, without prejudice to the right to request reimbursement of any redelivery or storage costs incurred.
5. Delivery with signature and insurance
The goods are shipped by insured courier. At the time of delivery, the signature of the addressee or a delegated person will be required for evidentiary purposes.
6. Exclusion of liability for external causes
IGE GOLD S.p.A. cannot be held responsible for delays or impossibility in delivery attributable to force majeure or events beyond its sphere of control, such as, but not limited to: war or terrorist events, natural disasters, general strikes, interruptions of essential public services, health emergencies, suspensions of transport or logistics activities, or delays attributable to the conduct of the recipient.
10. Availability of assets
If, in a few exceptional and unforeseeable cases, the ordered goods are not available, the order will not be processed, and the user will be promptly informed. In case of payment already made, IGE GOLD S.p.A. will refund within 30 days.
11. Compatibility and Product Information – Full Summary
The user is responsible for verifying, before purchasing, that the products are compatible with the intended use. The IGE GOLD website is the only official source of reference for these checks. In the event of discrepancies with information provided by other sites or sources, the specifications present at the time of purchase on the IGE GOLD website shall prevail.
Due to limitations in on-screen display, the color and design displayed may differ slightly from the actual product. The dimensions and weight shown on the site are to be considered indicative, with margins of tolerance related to the manufacturing processes.
In the case of customizations (e.g. engravings), these are made after the production of the ingot, and may cause slight variations in weight, depending on the symbol or text chosen.
In the event of a mismatch between the product received and ordered, incomplete delivery or transport damage, the user must promptly contact the Customer Service Center by email, in compliance with the terms of the law indicated in the "Warranties" paragraph. 12. Transfer of risk
The risk of loss or damage to the goods is transferred to the user at the time of physical delivery of the same.
13. Anti-money laundering obligations
IGE GOLD S.p.A., as a Professional Gold Operator, reserves the right to request additional documentation (identity document, tax code, KYC form, etc.) pursuant to Legislative Decree 90/2017. The shipment will be subject to the receipt and positive verification of the documentation.
14. Termination
The customer can exercise the right of withdrawal, without having to indicate the reason, within 14 working days of receipt of the goods. The notice of withdrawal must be sent through one of the following channels:
• Registered mail with return receipt to the address: IGE GOLD S.p.A., Via Giacomo Konz 104, 52100 Arezzo (AR) ITALY;
• PEC to: [email protected];
• Contact form available on the IGE GOLD e-store.
Conditions for exercising the withdrawal:
• Exclusion for personalised products: the withdrawal does not apply to personalised products (e.g. engravings). Physical restitution is allowed, but IGE GOLD S.p.A. may retain management costs and only partially refund based on the change in the value of the gold.
• The withdrawal must concern the entire product purchased, not just a part.
• The goods must be intact and returned in the complete original packaging.
• Return costs: To be paid by the customer.
• In the event of a dispute about the purity of the metal, the same conditions apply, with shipping responsibility borne by the customer until receipt in the warehouse.
Responsibilities and risks when returning:
• If the product is damaged during transport, IGE GOLD S.p.A. will inform the customer within 5 days to allow the courier to report and cancel the withdrawal. The product will be returned to the customer.
• If the customer has not insured the shipment, IGE GOLD S.p.A. will not be liable for theft, loss or damage not attributable to transport.
• If the returned product is found to be damaged, a percentage of the refund will be retained to cover the cost of repair.
Repayment:
• Subject to restoration costs, the customer will receive a full refund of the value of the product (excluding shipping costs) by bank transfer or PayPal, within 14 days of receipt of the goods.
• It is the customer's responsibility to promptly provide the bank details (holder and IBAN).
Forfeiture of the right of withdrawal:
The withdrawal lapses if IGE GOLD S.p.A. ascertains:
• The absence of essential elements of the product;
• Damage to the property not resulting from transport.
In such cases, the product will be returned to the customer, with shipping costs at the customer's expense.
15. Recording phone calls
By accepting these Terms and Conditions, the Client acknowledges and agrees that any telephone conversations held with the assistance and support staff of IGE GOLD S.p.A . may be recorded with the Client's prior authorization.
These registrations will be made exclusively for purposes related to:
• the correct identification of the Customer and the verification of his identity;
• the fulfilment of contractual and legal obligations;
• the protection of the rights of the parties, including in litigation;
• monitoring of the quality of the service and staff training.
The processing of personal data related to the recording of calls will be carried out in full compliance with the applicable legislation, in particular Regulation (EU) 2016/679 (hereinafter "GDPR") and Legislative Decree no. 196 of 30 June 2003, as amended and supplemented by Legislative Decree no. 101 of 10 August 2018.
The data collected through registration will be stored for the time strictly necessary to pursue the purposes indicated above and in any case within the time limits provided for by current legislation. The Customer may at any time exercise the rights recognized by art. 15 et seq. of the GDPR, by contacting the Data Controller in the manner indicated in the Privacy Policy.
16. Review Request Channels
By accepting the Terms and Conditions of Sale, the user authorizes IGE GOLD S.p.A. to contact them for customer satisfaction and review request purposes, through the following channels:
If any provision of these Terms of Sale is held to be unlawful, void or, for any reason, unenforceable, that provision shall be deemed severable from these Terms of Sale and shall not affect the validity or enforceability of the remaining provisions. The provision that is unlawful, void, or that is unenforceable for any reason, shall be replaced by a valid provision whose rationale or "economic purpose" is as close as possible to the provision that is unlawful, void, or that is for any reason unenforceable.
19. Applicable Law and Jurisdiction

- 17. Liability
- These Terms and Conditions of Sale establish all the obligations and responsibilities of IGE GOLD S.p.A. with regard to the purchase and sale of products through the IGE GOLD website. In particular, IGE GOLD S.p.A. does not guarantee that the products are suitable for the intended purposes/expectations or requests of the user.
- Nothing in these Terms of Sale shall exclude or limit the liability provided for by law on the part of IGE GOLD S.p.A.
