General Terms and Conditions of Sale

These Conditions have been drawn up in accordance with Legislative Decree no. 206 of 6 September 2005, containing the "Consumer Code", as coordinated and updated, most recently, pursuant to Legislative Decree no. 76 of 16 July 2020, converted with amendments by Law no. 120 of 11 September 2020.
IGE GOLD S.p.A. acts as producer and seller of the goods purchased through the above-mentioned website.
By accessing and operating on the IGE GOLD website, the user fully accepts these Terms and Conditions and acknowledges the relevant privacy policy, available via a special hyperlink.
· "User" or "Customer": any person, natural or legal, who makes purchases on the site.
· "Consumer": the natural person who acts for purposes unrelated to his or her business, trade, craft or profession.
· "Professional" or "Enterprise": a person acting in the context of his or her economic or professional activity.

Conclusion of the contract
The contract is considered concluded only after the user has received the order confirmation and payment of the price in full. Confirmation will be sent to the e-mail address provided during registration.
Price, taxes and ancillary charges
Prices are indicated in Euros, including VAT where applicable and tax charges. Shipping and handling charges, if applicable, will be detailed separately prior to order completion.
Payment methods
Payment must be made using one of the methods provided by the site. In the absence of authorization, the order will be canceled. You can be charged in one or more stages, depending on the payment method you select.
Exclusion of the right of withdrawal
By signing these GTCS, the Client acknowledges that all gold gift bars marketed by IGE GOLD S.p.A. are goods customized according to the specific requests and goods whose price is subject to fluctuations in the precious metals market. Therefore, pursuant to articles 52 et seq. and article 59, paragraph 1, letters b) and c) of Legislative Decree 206/2005 (Consumer Code), the right of withdrawal within 14 days of delivery is excluded.
Order cancellation at the customer's request
In order to privilege the relationship with customers, IGE GOLD S.p.A. may, at the request of the Customer and at its sole discretion, proceed with the cancellation only if the product has not yet been sent for personalization processing. In this case, the refund will be made net of the costs of order cancellation and collection equal to 7% of the total amount of the order.
Once the customization process has started, regardless of the shipment, any subsequent request from the Customer pursuant to art. 1326 and 1372 of the Italian Civil Code cannot constitute cancellation of the order. The customized bar, being made at the specific request of the Customer and therefore not marketable, cannot be put back on the market by IGE GOLD S.p.A., which will not be required to reimburse us. The Customer will therefore be obliged to accept the delivery. As an alternative to delivery, any refunds granted as a mere commercial courtesy will in any case be made net of:
In any case, in the event of significant fluctuations in the value of precious metals, IGE GOLD S.p.A. reserves the right to apply the appropriate economic adjustments related to changes in the value of the metal, as well as to charge the Client for any additional costs deriving from significant increases in the relative prices.
Cancellation of the order for reasons attributable to IGE GOLD S.p.A
IGE GOLD S.p.A. reserves the right to cancel the order for reasons attributable to it, such as, but not limited to:
The amount paid by the customer will be refunded in full, using the same means of payment used for the order, unless otherwise agreed with the customer.
Order cancellation for late shipping
It is also understood that, if IGE GOLD S.p.A. does not ship the product within the terms advertised on the e-store, which are considered binding, the customer will have the right to request the cancellation of the order with a full refund of the sums paid, without charges to him.
Full refunds
Following any full refund, IGE GOLD S.p.A. will not be required to pay any further amount by way of penalty, indemnity or compensation, excluding further economic claims by the customer.
Non-delivery attributable to the customer
In the event that the Client refuses or delays, without justified reason, the receipt of the goods, fails to provide the information necessary for delivery or indicates an incomplete or incorrect address that prevents their execution, the product will be returned to IGE GOLD S.p.A. The latter will therefore be exempt from the obligation to deliver within the terms indicated, without prejudice to the right to obtain reimbursement of the costs incurred for the redelivery, the stock or any other operations made necessary. IGE GOLD S.p.A. is not liable for errors in the indication of the delivery address, storage periods or failure to collect the goods attributable to the Customer. In such cases, no Order will be reshipped until the Client has paid in full the shipping costs, duties, taxes and any other costs incurred or anticipated, including the costs relating to any new shipment. The status of the shipment will be monitored by sending an e-mail from IGE GOLD S.p.A., containing the tracking code provided by the courier in charge of the delivery, which will allow the Customer to follow its progress. The information provided by the courier is for information purposes only and does not constitute a binding commitment for IGE GOLD S.p.A.
Shipping and delivery times
Pursuant to art. 22, 49 and 61 of Legislative Decree 206/2005 ("Consumer Code"), the shipping times advertised on the IGE GOLD S.p.A. e-store will be considered binding for the purposes of executing the order; in the absence of a different express indication on the e-store, the shipment of the products will take place within 5 (five) working days from the confirmation of payment and, in any case, IGE GOLD S.p.A. undertakes to guarantee the delivery of the goods no later than 30 (thirty) days from the conclusion of the contract, in compliance with art. 61 of the Consumer Code, except for the occurrence of events attributable to force majeure.
Force majeure and unserved territories
In the event of events that qualify as force majeure – including, but not limited to, natural disasters, civil unrest, strikes, pandemics, measures taken by the authorities or unavailability of logistics services, IGE GOLD S.p.A. reserves the right to suspend, postpone or, in the most serious cases, cancel the delivery, in particular in territories that, even if only temporarily, are not serviceable by the appointed carriers. The update on the operation of the delivery areas will be guaranteed based on the periodic communications received from the affiliated logistics courier.
Courier replacement
IGE GOLD S.p.A. reserves the right, at its sole discretion, to designate and/or replace the courier in charge of carrying out the delivery, in order to guarantee the timeliness and efficiency of the service.
Exclusion of liability for external causes
IGE GOLD S.p.A. cannot be held responsible for delays or impossibility in delivery attributable to force majeure or events beyond its sphere of control, such as, but not limited to: war or terrorist events, natural disasters, general strikes, interruptions of essential public services, health emergencies, suspensions of transport or logistics activities, or delays attributable to the conduct of the recipient.
Compatibility and Product Information – Full Summary
The user is responsible for verifying, before purchasing, that the products are compatible with the intended use. The IGE GOLD website is the only official source of reference for these verifications. In the event of discrepancies with information provided by other sites or sources, the specifications present at the time of purchase on the IGE GOLD website shall prevail. Due to limitations in on-screen display, the color and design displayed may differ slightly from the actual product. The dimensions and weight shown on the site are to be considered indicative, with margins of tolerance related to the manufacturing processes.
In the case of customizations (e.g. engravings), these are made after the production of the ingot, and may cause slight variations in weight, depending on the symbol or text chosen.
In the event of a mismatch between the product received and ordered, incomplete delivery or transport damage, the user must promptly contact the Customer Service Center by email, in compliance with the terms of the law indicated in the "Warranties" paragraph. Updated contact details are available on the official website.
Transfer of ownership and risk
The transfer of ownership and the risk of loss or damage to the goods is transferred to the user at the time of physical delivery of the same.
Anti-money laundering obligations
In cases where, in compliance with the provisions in force on anti-money laundering and fraud prevention, or in the presence of anomalous or suspicious transactions or payments, it is necessary to request additional documentation and/or carry out checks, the Client acknowledges and expressly accepts that the order processing times may be delayed.
These controls, imposed by current legislation and carried out to protect both parties, may in no case be charged or constitute a source of liability of IGE GOLD S.p.A.
Recording phone calls
By accepting these Terms and Conditions, the Client acknowledges and agrees that any telephone conversations held with the assistance and support staff of IGE GOLD S.p.A . may be recorded with the Client's prior authorization.
These registrations will be made exclusively for purposes related to:
• the correct identification of the Customer and the verification of his identity;
• the fulfilment of contractual and legal obligations;
• the protection of the rights of the parties, including in litigation;
• monitoring of the quality of the service and staff training.
The processing of personal data related to the recording of calls will be carried out in full compliance with the applicable legislation, in particular Regulation (EU) 2016/679 (hereinafter "GDPR") and Legislative Decree no. 196 of 30 June 2003, as amended and supplemented by Legislative Decree no. 101 of 10 August 2018.
The data collected through registration will be stored for the time strictly necessary to pursue the purposes indicated above and in any case within the time limits provided for by current legislation. The Customer may at any time exercise the rights recognized by art. 15 et seq. of the GDPR, by contacting the Data Controller in the manner indicated in the Privacy Policy.

By accepting the Terms and Conditions of Sale, the user authorizes IGE GOLD S.p.A. to contact them for customer satisfaction and review request purposes, through the following channels:

Responsibility
These Terms and Conditions of Sale set out all the obligations and responsibilities of IGE GOLD S.p.A. with regard to the purchase and sale of products through the IGE GOLD website. In particular, IGE GOLD S.p.A. does not guarantee that the products are suitable for the intended purposes/expectations or requests of the user.
Nothing in these Terms of Sale shall exclude or limit the liability provided for by law on the part of IGE GOLD S.p.A.
Severability clause
If any provision of these Terms of Sale is held to be unlawful, void or, for any reason, unenforceable, that provision shall be deemed severable from these Terms of Sale and shall not affect the validity or enforceability of the remaining provisions. The provision that is unlawful, void, or that is unenforceable for any reason, shall be replaced by a valid provision whose rationale or "economic purpose" is as close as possible to the provision that is unlawful, void, or that is for any reason unenforceable.
Applicable law and jurisdiction
The Contract is governed by Italian law. Any dispute relating to the application, execution, interpretation and/or violation of the Contract, where the customer is a consumer, will be the responsibility of the Court in which he has his residence or domicile, if located in the territory of the Italian State, or of the exclusive Court of Arezzo if the Customer has his residence or domicile abroad and in any case does not have the quality of
consumer.

Premise

IGE GOLD S.p.A., has its registered office in Via Giacomo Konz 104, 52100 Arezzo (AR), Italy, VAT number 02488190519, registered in the Arezzo-Siena Register of Companies no. REA AR-220605, fully paid-up share capital of Euro 1,000,000. The Company is registered with the OAM - Organismo Agenti e Mediatori - as a Professional Gold Operator with code OPO38.IGE GOLD S.p.A. acts as producer and seller of the goods purchased through the above-mentioned website.

Scope and definitions

- sudden changes in the value of precious metals such as to significantly affect the feasibility of the supply or the economic equilibrium of the transaction;
- supervening unavailability of the product or raw materials;
- obvious errors in price or description on the e-store or in the information material;
- technical, organizational or internal management reasons that prevent the order from being processed within the stated timeframe.
The amount paid by the customer will be refunded in full, using the same means of payment used for the order, unless otherwise agreed with the customer.
